Private law and ethical life In Das Recht der Freiheit Axel Honneth develops his concept of social freedom. In this article I discuss Honneth’s project and critique one of its crucial aspects: Honneth’s views on the disruptive role of legal freedom in our society and its dependent relation to the sphere of social freedom. I argue that in his attempt in Das Recht der Freiheit to reactualize Hegel’s discourse on the realization of freedom for our time, Honneth risks mistranslating Hegel’s (...) discourse of ‘right’ by denying the sphere of legal relations a constitutive role for true freedom, and that because of this Honneth’s own theory of social freedom suffers: it becomes less clear whether it can still offer helpful insights into the proper place of legal freedom in our society. The article focuses on Patočka early phenomenological thought developed around the concept of the natural world. More precisely, the aim of the article is to explore Patočka recently published manuscript studies and fragments, dating from the first half of the 1940s, in which Patočka attempts to establish a deeper living correlation between man and world based on a certain metaphysical conception of nature which is not, as for Husserl, just one of the horizons which experiencing creates around itself, nor it (...) is just a basis on which the harmony of experiencing and its evironment must develop, but in which nature also includes an aspect which is closed and alien to subjectivity. In this way, the article shows that Patočka makes a step beyond of Husserl's and Heidegger's schemes of a correlation of life and world, understanding and being. The article thus shows that Patočka early writings throw a certain amount of light on his later phenomenological work that had been most notably developed from 1960s onwards. (shrink)

Evaluating clinical ethics support services has been hailed as important research task. At the same time, there is considerable debate about how to evaluate CESS appropriately. The criticism, which has been aired, refers to normative as well as empirical aspects of evaluating CESS. In this paper, we argue that a first necessary step for progress is to better understand the intervention in CESS. Tools of complex intervention research methodology may provide relevant means in this respect. In a first step, we (...) introduce principles of “complex intervention research” and show how CESS fulfil the criteria of “complex interventions”. In a second step, we develop a generic “conceptual framework” for “ethics consultation on request” as standard for many forms of ethics consultation in clinical ethics practice. We apply this conceptual framework to the model of “bioethics mediation” to make explicit the specific structural and procedural elements of this form of ethics consultation on request. In a final step we conduct a comparative analysis of two different types of CESS, which have been subject to evaluation research: “proactive ethics consultation” and “moral case deliberation” and discuss implications for evaluating both types of CESS. To make explicit different premises of implemented CESS interventions by means of conceptual frameworks can inform the search for sound empirical evaluation of CESS. In addition, such work provides a starting point for further reflection about what it means to offer “good” CESS. (shrink)

This paper explores the fact that linear opinion pooling can be represented as a Bayesian update on the opinions of others. It uses this fact to propose a new interpretation of the pooling weights. Relative to certain modelling assumptions the weights can be equated with the so-called truth-conduciveness known from the context of Condorcet's jury theorem. This suggests a novel way to elicit the weights.

Hilbert's axiomatization program of physical theories met an interesting challenge when it confronted the rise of quantum mechanics in the mid-twenties. The novelty of the mathematical apparatus of the then newly born theory was to be matched only by its substantial lack of any definite physical interpretation. The early attempts at axiomatization, which are described here, reflect all the difficulty of the task faced by Jordan, Hilbert, von Neumann and others. The role of von Neumann is examined in considerable detail (...) as he can be viewed here as the most outstanding of Hilbert's heirs. Von Neumann, especially in his work devoted to the proof of the impossibility of hidden variables, not only continued Hilbert's program but pushed it to its very limits, blending axiomatic rigor and interpretative commitment. This paper discusses ἐπιβολαὶ τῆς διανοίας, which later Epicureans are supposed to have elevated to a fourth criterion of truth to complement perceptions, preconceptions and feelings. By examining Epicurus’ extant writings, the paper distinguishes three different senses of the term: ‘thought in general’, ‘act of attention’ and ‘mental perception’. It is argued that only the sense ‘mental perception’ yields a plausible reading of ἐπιβολαί as a criterion of truth. The paper then turns to the textual evidence on ἐπιβολαί in later (...) authors. While the term ἐπιβολή is not used by Cicero, Lucretius and Philodemus in the sense of mental perception, it is argued that this still is the most plausible way of understanding ἐπιβολή as a criterion of truth. This article analyses domestic and foreign reactions to a 2008 report in the British Medical Journal on the complementary and, as argued, synergistic relationship between palliative care and euthanasia in Belgium. The earliest initiators of palliative care in Belgium in the late 1970s held the view that access to proper palliative care was a precondition for euthanasia to be acceptable and that euthanasia and palliative care could, and should, develop together. Advocates of euthanasia including author Jan Bernheim, independent from but (...) together with British expatriates, were among the founders of what was probably the first palliative care service in Europe outside of the United Kingdom. In what has become known as the Belgian model of integral end-of-life care, euthanasia is an available option, also at the end of a palliative care pathway. This approach became the majority view among the wider Belgian public, palliative care workers, other health professionals, and legislators. The legal regulation of euthanasia in 2002 was preceded and followed by a considerable expansion of palliative care services. It is argued that this synergistic development was made possible by public confidence in the health care system and widespread progressive social attitudes that gave rise to a high level of community support for both palliative care and euthanasia. The Belgian model of so-called integral end-of-life care is continuing to evolve, with constant scrutiny of practice and improvements to procedures. It still exhibits several imperfections, for which some solutions are being developed. This article analyses this model by way of answers to a series of questions posed by Journal of Bioethical Inquiry consulting editor Michael Ashby to the Belgian authors. (shrink)

In the literature, regress arguments often take one of two different forms: either they conclude that a given solution fails to solve any problem of a certain kind (the strong conclusion), or they conclude that a given solution fails to solve all problems of a certain kind (the weaker conclusion). This gives rise to a logical problem: do regresses entail the strong or the weaker conclusion, or none? In this paper I demonstrate that regress arguments can in fact take both (...) forms, and clearly set out the logical difference between them. Throughout the paper, I confine myself to metaphysical examples from the early Russell. Only now that we know they are valid can we start to discuss whether they are sound. (shrink)

Non-invasive brain stimulation promises innovative experimental possibilities for psychology and neurosci- ence as well as new therapeutic and palliative measures in medicine. Because of its good risk–benefit ratio, non-invasiveness and reversibility as well as its low effort and cost it has good chances of becoming a wide- spread tool in science, medicine and even in lay use. While most issues in medical and research ethics such as informed consent, safety, and potential for misuse can be handled with manageable effort, the (...) real promise of brain stimulation does raise one prominent moral worry: it may lay the foundation of reliable, precise and stable manipulations of the mind. This article addresses this worry and concludes that it is not the possibility of manipulation, but the shift in our understanding of our mind which stands in need of careful consideration. (shrink)

An inquiry into the bioethical or ethical component of post-humanism can be through the question of sex. Following from Manoj’s idea of a cyborg as having a “sexless” possibility, this paper presents other arguments that advance the possibility of asexuality in the posthuman. First, I begin with a discussion of Žižek’s point concerning the cessation or voiding of sexual difference. Second, I will continue such an argument through the selfreplicating possibilities of cloning and full cyberspace immersion, the later as prototyped (...) by Pokémon. And finally, there seems to be an inevitable thread that begs to link the concept of the posthuman to Nietzsche; so I will explore some of the arguments that include or exclude Nietzschean ethics in this prospect. This book deals with the history of the problem whether or not time can fully exist without the mind. This has been a vital issue in the philosophy of time, with intriguing arguments and solutions, from Aristotle to the present.

This paper investigates the distinction between determining and modifying expressions that played an important role in the Brentano School. The focus lies on how the distinction is applied to adjectives by Anton Marty and Kazimierz Twardowski. In ‘heavy gun’, ‘heavy’ plays a determining role: heavy guns are guns; in ‘fake gun’, ‘fake’ plays a modifying role: fake guns are no guns at all. According to Marty and Twardowski, when a modifying adjective is combined with a noun, it shifts the meaning (...) of the noun. This paper rejects this proposal and proposes a better account which was developed by Bernard Bolzano: the difference between determining and modifying adjectives must be understood in terms of how their meanings figure in meaning analyses of adjective-noun combinations. We introduce a cyclic proof system for the two-way alternation-free modal μ-calculus. The system manipulates one-sided Gentzen sequents and locally deals with the backwards modalities by allowing analytic applications of the cut rule. The global effect of backwards modalities on traces is handled by making the semantics relative to a specific strategy of the opponent in the evaluation game. This allows us to augment sequents by so-called trace atoms, describing traces that the proponent can construct against the opponent’s strategy. The (...) idea for trace atoms comes from Vardi’s reduction of alternating two-way automata to deterministic one-way automata. Using the multi-focus annotations introduced earlier by Marti and Venema, we turn this trace-based system into a path-based system. We prove that our system is sound for all sequents and complete for sequents not containing trace atoms. (shrink)

Logik und Semantik sind im Mittelalter so eng miteinander verknupft, dass die Trennung beider Gebiete das Verstandnis der Probleme beeintrachtigen wurde. Die spezifische Leistung der mittelalterlichen Logik besteht in der Analyse der semantischen Voraussetzungen der aristotelischen Logik und dem damit verbundenen Versuch, die semantischen Voraussetzungen der naturlichen Sprachen zu untersuchen. Damit haben die mittelalterlichen Logiker eine Arbeit geleistet, die von Aristoteles und lange Zeit auch von der modernen Logik vernachlassigt wurde.

In this article I am dealing mainly with the following notions: “perception apparatus” (Weltbildapparat), “view of the world” (Weltbild, picture of the world) and “representation”. The first and the second ones belong to the basic notions in the vocabulary of K. Lorenz’s evolutionary epistemology, the third in cognitive sciences. I seek to demonstrate the relationships between them. This analysis is put in a broader context, indicating the relationships between expensively developing cognitive sciences and evolutionary epistemology (much less popular today). It (...) is quite easy to determine what the perception apparatus is, however, it is harder to state what the view of the world, especially in its ontological aspect, is. Nevertheless, the view of the representation in the context of evolutionary epistemology points to the fact that this notion is still unclear and many representational features can be assigned to objects which, as it seems, are not representations according to cognitive sciences. Objectives To determine the frequencies and types of limitation of medical treatment performed by physician members of the German Society for Palliative Medicine and to analyse the findings with respect to clinical and ethical aspects of end-of-life practices. Design Cross-sectional postal survey. Setting Data collection via the secretary of the German Society for Palliative Medicine using the German language version of the EURELD survey instrument. Subjects All 1645 physician members of the German Society for Palliative Medicine. Main outcome measures Types (...) and frequencies of limitation of treatment and possible determinants. Results 901 physicians participated in the study (response rate 55.8%). Participants reported limitation of treatment in 69.1% of cases. These decisions most often affected artificial nutrition (19%), chemotherapy (14%), antibiotics (11%) and medication other than antibiotics (11%). In the majority of eligible cases, physicians estimated the life-shortening effect of limitation of treatment to be <7 days. However, estimations differ depending on the medical measures in question. Bivariate statistical analysis indicated that withholding of treatment was performed significantly more frequently for patients aged ≥65 years (p=0.019). In addition, there were significant associations between the incidence of limitation of treatment and the different diseases reported by respondents as the underlying cause of death. Conclusion The findings of this study provide information on the current state of an ethically and clinically challenging aspect of clinical practice and can serve as a starting point for further interdisciplinary research on normative and empirical aspects of treatment decision-making at the end of life. Rationality requires us to have certain propositional attitudes (beliefs, intentions, etc.) given certain other attitudes that we have. Carroll’s Tortoise repeatedly shows up in this discussion. Following up on Brunero (Ethical Theory Moral Pract 8:557–569, 2005), I ask what Carroll-style considerations actually prove. This paper rejects two existing suggestions, and defends a third.

The notion of “weak action” is developed in this paper in an attempt to overcome the schism between the action of a free political subject on the one hand, and their dependency on the support of others and the environment on the other. This paper focuses foremost on Judith Butler’s later work raising two different questions. First, following Butler and her critical reading of Levinas, the problem is raised how and at what price the ethics of vulnerability would be able (...) to become not only the source of a critique of politics, but also the source of a concrete political action. Second, through Butler’s reinterpretation of Arendt’s political thinking, the notion of “action” is enriched by the dimension of vulnerability. (shrink)

This paper describes the common techniques used in the constitution of candidates-lists for parliamentary elections. A common feature of these techniques is the consultation of party members. But the way in which this is done differs among the parties. AGALEV, the ecologist party, offers every member the possibility to have his say about every candidate. The socialist party uses this system in two constituencies ; in the other constituencies a special congress decides. The christiandemocrats, the liberals and the Flemish nationalists (...) constitute their lists by indirect vote : the leadership performs a first selection and the members then either approve or disapprove of this choice.Our research indicates that there are no essential differences between these two techniques from the point of view of membership participation.In both the ecologist and the socialist party the majority of members does not participate in the candidates-elections. Therefore, as with the indirect vote, candidates-lists are constituted by an active, militant and elitist group of members. Whatever the technique used the infl,uence of the rank-and-file-member is small. (shrink)
